1. ONLINE STORE
Our store sells clothing, combat-sports apparel, rash guards and related products.
You must provide accurate, current and complete information when placing an order.
You may not use our products or website for any unlawful or fraudulent purpose.
2. PRODUCTS
We make reasonable efforts to display and describe our products accurately, including their colours, designs, sizes and specifications.
However, colours and appearance may vary slightly depending on your device, screen or display settings.
Product availability may change without notice.
3. PRICES
Prices displayed on our store are shown in the currency indicated at checkout.
Where applicable, prices include VAT unless clearly stated otherwise.
Any applicable delivery charges will be clearly displayed before you complete your purchase.
We reserve the right to change product prices at any time before an order is placed.
Once an order has been accepted, the agreed price will not be changed except where required by law or where an obvious pricing error has occurred.
4. ORDERS AND CONTRACT FORMATION
Placing an order constitutes an offer to purchase the selected products.
After placing an order, you will receive an electronic confirmation.
A binding sales contract is formed when we accept your order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- payment cannot be authorised;
- incorrect information has been provided;
- an obvious pricing or product-description error has occurred;
- we reasonably suspect fraudulent or unlawful activity.
If we cancel an order after payment has been received, the amount paid will be refunded in accordance with applicable law.
5. PAYMENT
Available payment methods will be displayed during checkout.
Payment must be successfully authorised before an order can be processed.
Payment services may be provided by third-party payment providers, including services made available through Shopify.
We do not receive or store complete payment-card details where payment is processed by an authorised third-party payment provider.
6. SHIPPING AND DELIVERY
Available delivery methods, estimated delivery times and shipping charges will be displayed during checkout where applicable.
Delivery times are estimates unless expressly stated otherwise.
We will fulfil orders without undue delay and in accordance with applicable Irish and EU consumer law.
CODEX BELLATORIS is not responsible for delays caused by circumstances genuinely outside our reasonable control. This does not affect any statutory rights you may have in relation to delayed or failed delivery.
7. RIGHT TO CANCEL – ONLINE PURCHASES
Consumers purchasing online generally have a statutory right to cancel their purchase without giving a reason within 14 days from the day on which they, or a person nominated by them, receive the goods, subject to exceptions provided by law.
To exercise this right, you must clearly inform us of your decision to cancel within the applicable cancellation period.
You may contact us at:
codexbellatoris@gmail.com
After notifying us of cancellation, goods must normally be returned within 14 days.
Further details are provided in our Return & Refund Policy.
8. RETURNS AND REFUNDS
Returns and refunds are governed by our Return & Refund Policy and applicable Irish and European Union consumer law.
Nothing in these Terms affects your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the sales contract.
9. CONDITION OF RETURNED PRODUCTS
Where a consumer exercises the statutory right to cancel, the consumer may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning.
Where handling goes beyond what would reasonably be permitted in a physical retail store and causes a reduction in the value of the goods, we may be entitled to make an appropriate deduction from the refund where permitted by law.
This does not affect statutory rights relating to faulty or non-conforming goods.
10. PERSONALISED AND HYGIENE-SENSITIVE PRODUCTS
Certain statutory exceptions to the right of cancellation may apply, including to goods made to the consumer's specifications or clearly personalised.
A statutory cancellation exception may also apply to sealed goods which are not suitable for return for health-protection or hygiene reasons where the goods have been unsealed after delivery, where the requirements of applicable law are satisfied.
These exceptions will only be relied upon where legally applicable.
11. FAULTY OR NON-CONFORMING GOODS
Products sold by CODEX BELLATORIS must comply with applicable Irish and European Union consumer law.
Consumers have statutory remedies where goods are faulty, not as described, not fit for their normal purpose or otherwise fail to conform to the sales contract.
Nothing in these Terms or in our Return & Refund Policy excludes or limits those statutory rights.
12. INTELLECTUAL PROPERTY
Unless otherwise stated, the CODEX BELLATORIS name, branding, logos, graphics, artwork, product designs, photographs, text and other original website content are owned by or licensed to CODEX BELLATORIS and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, commercially exploit or use such content without permission where such use would infringe our intellectual-property rights.
13. PROHIBITED USE
You must not use our website:
- for unlawful or fraudulent purposes;
- to violate applicable laws or regulations;
- to infringe intellectual-property rights;
- to transmit malicious software or harmful code;
- to interfere with the security or operation of the website;
- to collect personal information unlawfully.
14. THIRD-PARTY SERVICES
Our store is hosted using Shopify and may use services supplied by other third parties, including payment, delivery, analytics and technology providers.
Your use of certain third-party services may also be subject to the relevant provider's terms and privacy practices.
15. PERSONAL DATA AND PRIVACY
Personal data is processed in accordance with our Privacy Policy and applicable data-protection law, including the General Data Protection Regulation (GDPR) and applicable Irish data-protection legislation.
Please review our Privacy Policy for further information.
16. LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
In particular, nothing in these Terms excludes or restricts any mandatory consumer rights or remedies available under Irish or European Union law.
To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control or losses that were not reasonably foreseeable when the contract was entered into.
17. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time, for example to reflect changes to our business, services or applicable law.
Changes will apply prospectively and will not remove rights already acquired under an existing consumer contract.
The version applicable to an order is generally the version made available to the customer when the order was placed.
18. GOVERNING LAW
These Terms are governed by the laws of Ireland.
If you are a consumer resident in another European Union Member State, this choice of law does not deprive you of any mandatory consumer protections available to you under the laws applicable to your situation.
Nothing in these Terms restricts any right a consumer may have to bring proceedings before a court having jurisdiction under applicable law.
19. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
